TERMS AND CONDITIONS: CLIENT
This agreement refers to the client of the cleaning, domestic kitchen services nude, topless and lingerie / outfit scheduled through the Naked Service (NS) platform.


Agreement for services
1. NS provides the client with the scheduling of cleaning services / naked domestic kitchen, topless and lingerie / outfit.
2. And the provider wants to provide the above services to NS customers.


Therefore, the parties here agree as follows:


General
1.1 NS agrees to schedule services with the cleaning / kitchen service provider to provide NS customers subject to the terms and conditions and also proceed with the providers' CV / profile / RC controls.
1.2 The provider is paid on arrival at the customer's property and must receive payment before carrying out the cleaning / kitchen service. If the customer does not settle the payment before the service, he must contact NS and leave the place without providing any service.
1.3 NS has a very strict age limit and only over 18 years old can customers and providers be registered.
1.4 The Client's address used for registration is the ONLY address to which the providers will go.

Term
2.1 The contracting period for the client will start on a date when this contract is accepted. And be renewed annually for € 89.99. Either party may terminate this agreement by providing the other party with at least 14 days notice, and NS may terminate the agreement at any time and without notice in the event of any breach of the clauses within this agreement.


Duties and Responsibilities.
3.1 The provider agrees to carry out work scheduled through NS under the terms and conditions set out in this agreement and agrees to devote all necessary time and attention to the performance of the functions specified in this agreement.
3.2 Scheduled services comprise the following light duties:
Cooking, washing dishes, vacuuming, general cleaning, bedding, washing / drying, polishing, cleaning bathrooms, cleaning / mopping floors, cleaning and cleaning internal windows (does not include cleaning at any time, the feet must always remain in floor).
3.3 None of the services below should be performed:
cleaning ovens, emptying crates, cleaning any other areas that pose any risk to the health and safety of the provider, unblocking pipes, services that require the use of strong chemicals, deep cleaning or excessive lifting of heavy items and any another heavy or risky task that may be considered by the provider.
3.4 The provider works according to NS schedules on its own account and is responsible for its own tax deductions / receipts required by law.
3.5 The provider must always look carefully when arriving at the customer's property.
Feminine appearance: formal black pants, high heels, with a formal top, with hair and makeup made for a neat and clean appearance.
Masculine appearance: formal trousers, shirt and formal shoes and a neat and clean appearance.
Cannot be used at any time: JEANS, TRAINING SUITS, SWEATSHIRTS, HATS, CAPS OR GORROS.
3.6 The provider will decline immediately and notify NS if asked by the customer to perform any other restricted service.
3.7 It is the customer's responsibility to provide the provider with cleaning materials / products / kitchen. The provider reserves the right to refuse the use of any material / equipment / product that appears unsafe or that represents an immediate danger to the provider, and the latter must inform NS by email, to info@nakedservices.pt, of this decision.
3.8 The provider will perform its functions and responsibilities in a professional and competent manner, completing substantially all the work on the days relating to the reservation in question.


Conduct
4.1 The provider acknowledges that he will provide a service in lingerie / outfit, nude or topless, requested by the customer when booking, during the full provision of the service.
4.2 The provider recognizes that the customer may be naked or dressed during the provision of services, at the customer's discretion.
4.3 Unless otherwise agreed and specifically notified by NS, the provider must not perform any service with more than one person present on the property.
4.4 The customer acknowledges that it will be a violation of this contract to initiate any physical or sexual conduct with the provider, whether the provider has consented to it or not.
4.5 Likewise, it should be a reason for a client to have any physical or sexual contact with the provider, with the client and provider agreeing to all the terms described recognizing that this is a contract exclusively for a cleaning service / kitchen in lingerie / outfit, nude or topless. Exclusively in the event of such an occurrence, the provider must immediately leave the site and notify NS so that the necessary measures can be taken.
4.6 The provider is additionally obliged to leave the customers' property
immediately if the customer is under the influence of alcohol / drugs or begins to consume the provider's presence.
4.7 The provider must under no circumstances accept any offers of drugs / alcohol, this being a breach of this agreement by the provider, just as the provider should not serve any of these substances to the client.
4.8 The provider must not pose or allow the customer to photograph / video during services. The provider must leave the site immediately if this occurs.
4.9 The customer must not offer to contract the services provided by NS directly to NS providers, at any time, nor make any attempt to make direct reservations outside NS. When verifying this type of behavior and as soon as it is verified, the customer is under this agreement, then subject to our fee of 2500 €. By signing our agreements on this document, you accept that you are aware that this payment is legally bound.


Safety
5.1 Notwithstanding none of the provisions of this clause 5, providers acknowledge that NS has taken all reasonable procedures within its means and signed relevant agreements to guarantee the integrity of customers and, therefore, is not responsible for the safety of the provider while working on the premises customers. The provider must remain vigilant and refuse to work in any facilities that it considers or has any reason to suspect are not safe.
Regardless of:
5.1.1 For security reasons, the provider must send an email to NS upon arrival at the customer's premises and, again, once it has left the site.
5.2 In case of hostile behavior, aggression or alcohol / drug use, the provider must leave the property with immediate effect.
5.3 The provider must not disclose any personal information, that is, home address, full name and contact number.
5.4 All communication between the customer and the provider regarding the service must pass through NS and not directly dealt with the provider.
5.5 NS advises providers to have a driver, that is, a taxi / Uber company to take them to the property and collect it. This is yet another method to safeguard providers knowing that they arrive and leave a certain location safely.

Confidentiality
6.1 NS guarantees to keep the client's personal information confidential and it will not be disclosed. All details are kept only in our computer software. We also inform you that we are in full compliance with the GDPR regulations.
6.2 The provider's guarantee is to keep the client's confidential information confidential and cannot disclose it to anyone other than law enforcement agencies when or if it is ever necessary.

Representations and Warranties
7.1 No representations or warranties have been made by NS to the customer, excluding those expressed in this agreement.


Responsibility
8.1 NS is not responsible for any loss or damage suffered by the customer on his property. In the area where the provider is performing its work or material handling, where such loss or damage is due to the provider's own negligence.
8.2 NS must not provide the provider with a workplace, the provider recognizes that the safety and well-being of the same must be guaranteed by the customer on whose property the provider is providing the service. The provider must immediately inform NS when a property becomes dangerous to work and NS will immediately notify the customer and terminate the service contract.
8.3 The provider is not obliged to provide services on any properties that he considers inappropriate or unsafe, as long as the provider notifies NS of such conditions before refusing to work.
8.4 The provider must have its own liability insurance.

The independent provider
9.1 In carrying out work, duties and obligations, in any way related to this agreement, it is recognized and agreed by the parties that the provider must be and at all times is acting and performing as an independent provider and must have total control over its provision of services to the customer, in the manner described here, how its services should be performed provided that the provider does not violate any of the conditions contained in this agreement.
9.2 Furthermore, the provider is not an agent, a party, a joint venture or an employee of NS. The provider must not have the authority to bind or otherwise oblige NS in any way, nor should it represent any person who has the right to do so.
9.3 The provider further agrees that if NS suffers loss or damage as a result of a breach by the provider of the provisions, it must indemnify and keep TNCC free from such loss or damage.
9.4 The provider has civil liability insurance.


Full Agreement
10.1 This agreement contains all the understanding and agreement between the parties and cannot be changed or altered in any way, except for a subsequent agreement.


Renounce
11.1 No waiver of any provision of this agreement will be considered, or will constitute a waiver of any other provision, whether similar, or any waiver will constitute a continuous waiver. No waiver will be binding unless it is carried out in writing by the party making the waiver.


National law
12.1 Any dispute regarding the violation of the interpretation of any provisions of this agreement is governed by the laws of Portugal. Portuguese courts have exclusive jurisdiction over all disputes that arise.

Additional
13.1 The parties acknowledge and agree that:
13.2 The parties are executing this agreement voluntarily and without any
undue pressure or influence.
13.3 The parties have read this agreement carefully and have asked all questions necessary to understand the terms, consequences and binding effect of this agreement and to fully understand them.
13.4 The parties sought the advice of a lawyer of their choice, if they so wish before signing the agreement.


Service hours
Monday to Sunday 9:00 - 22:00

All providers must be out of the client's properties by the end of our working hours
and sent an email to NS to clarify the end of the shift.


DECLARATION: CUSTOMER DECLARES TO HAVE READ AND UNDERSTAND THE
TERMS OF THIS POLICY AND YOU AGREE TO BE LEGALLY LINKED TO THEM.
